Terms of Service

By downloading, installing, or using any Moyqua application or accessing the Moyqua web platform, you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use our services.
1. Overview
Moyqua is a B2B fleet car wash management platform that connects enterprise fleet managers, drivers, and car wash operators ("Washers"). The platform facilitates scheduling, tracking, and reporting of car wash services for corporate vehicle fleets.
2. Eligibility
- You must be at least 18 years old to use Moyqua
- Driver accounts require authorization from an enterprise fleet manager
- Washer accounts require a partnership agreement with Moyqua
- Enterprise accounts require a valid business entity
3. Account Responsibilities
You are responsible for:
- Maintaining the security of your login credentials
- All activity that occurs under your account
- Providing accurate and current information
- Notifying us immediately of unauthorized access
4. Acceptable Use
You agree not to:
- Use the platform for any unlawful purpose
- Attempt to gain unauthorized access to other accounts or systems
- Interfere with or disrupt the platform's operation
- Submit false transaction data or fraudulent wash records
- Use automated systems (bots, scrapers) to access the platform
- Share your account credentials with others
- Reverse engineer, decompile, or disassemble the application
5. Services and Transactions
For Enterprises
- You may register vehicles and assign drivers to your fleet
- Wash eligibility rules and policies are configurable per enterprise
- Transaction records and reports are available through the platform
- Billing is based on completed wash transactions as per your agreement
For Drivers
- You may use the app to locate car washes and track wash history
- Vehicle eligibility is determined by your enterprise's policy
- You are responsible for confirming or disputing completed washes
For Washers
- You must scan vehicle QR codes to initiate and complete washes
- Proof-of-service photos are required for wash completion
- Platform commission is deducted from each transaction as per your partnership agreement
- Washer accounts may be disabled if average ratings fall below the platform threshold
6. Payments and Commission
Moyqua facilitates transaction tracking between parties. Payment terms, commission rates, and billing cycles are established in separate partnership agreements between Moyqua and each enterprise or car wash operator. The platform commission rate is displayed in the app and may be updated with notice.
7. Content and Photos
By uploading photos or content to the platform, you grant Moyqua a non-exclusive, worldwide license to store, process, and display that content for the purpose of providing the service. Proof-of-service photos are shared with relevant transaction participants (driver, enterprise).
8. Intellectual Property
The Moyqua platform, including its design, branding, source code, and content, is owned by Moyqua and protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works based on the platform without explicit written permission.
9. Termination
We may suspend or terminate your account if you violate these Terms, engage in fraudulent activity, or at our discretion with reasonable notice. Upon termination:
- Your access to the platform will be revoked
- Pending transactions may be resolved at our discretion
- Data retention follows our Privacy Policy
10. Disclaimer of Warranties
The platform is provided "as is" and "as available" without warranties of any kind, express or implied. We do not guarantee:
- Uninterrupted or error-free operation
- The quality of car wash services provided by third-party operators
- Accuracy of location data or map information
11. Limitation of Liability
To the fullest extent permitted by law, Moyqua shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the platform. Our total liability for any claim shall not exceed the fees paid by you in the twelve months preceding the claim.
12. Indemnification
You agree to indemnify and hold harmless Moyqua from any claims, damages, or expenses arising from your use of the platform, your violation of these Terms, or your violation of any rights of a third party.
13. Changes to These Terms
We may modify these Terms at any time. Material changes will be communicated through the app or platform with at least 14 days' notice. Continued use after changes take effect constitutes acceptance.
14. Governing Law
These Terms are governed by and construed in accordance with the laws of the Republic of Azerbaijan. Any disputes shall be resolved in the courts of Baku, Azerbaijan.
